Terms of Service

These Terms of Service explain the rules for using MornUp. By using MornUp, you agree to these Terms.

Agreement and Apple terms

These Terms of Service govern your use of the MornUp app, website, and related services. By using MornUp, you agree to these Terms.

If you download MornUp through the Apple App Store, the Apple Standard EULA applies in addition to these Terms unless we provide a valid custom license that replaces it. Apple is not responsible for MornUp, support, maintenance, claims, investigations, or disputes related to your use of the app.

You must also follow any applicable Apple Media Services Terms and App Store rules for downloads, purchases, subscriptions, refunds, and device use.

Using MornUp

MornUp provides wake-up accountability tools, including alarms, missions, wake-up checks, sleep reminders, streaks, insights, and progress features. You are responsible for using the app safely, lawfully, and appropriately.

Some features require device permissions, an Apple ID, an account, internet access, an active subscription, or supported iOS features. Features may vary by device, operating system version, region, purchase status, or service availability.

Accounts, sync, and deletion

You may use Sign in with Apple to connect MornUp data to an account. You are responsible for the activity that occurs through your account and for keeping your device and account credentials secure.

You may request account deletion from Settings > Account Settings in the app or by contacting support@mornup.app. Deletion requests are processed as described in the Privacy Policy.

Subscriptions, trials, billing, and cancellation

MornUp may offer paid features through monthly, yearly, promotional, free trial, or other App Store subscription options. The price, billing period, trial length, renewal terms, included features, and any offer limits are shown before purchase in the app or App Store purchase sheet.

App Store subscriptions are auto-renewing subscription purchases charged to your Apple ID. Unless canceled, a subscription renews automatically and your Apple ID may be charged within 24 hours before the end of the current period.

You can manage or cancel through your Apple ID subscription settings in the App Store. Cancellation must be completed at least 24 hours before the current period ends to avoid renewal. Refunds, if available, are handled by Apple according to App Store rules.

Use Restore Purchase in MornUp where available if you need to reconnect an existing App Store purchase to the app.

Alarm reliability and backup alarms

We work to make MornUp reliable, but alarms, notifications, sounds, and mission flows can be affected by device settings, volume, Focus modes, battery level, operating system behavior, permissions, network conditions, app updates, and other factors outside our control.

Do not rely on MornUp as your only alarm for medical needs, emergency response, transportation, employment obligations, school exams, travel, caregiving, legal deadlines, or any situation where a missed alarm could cause harm. Keep a separate backup alarm where needed.

Health and safety

MornUp is a habit and accountability tool. It is not medical advice, sleep disorder diagnosis, treatment, therapy, or emergency service.

Do not complete missions while driving, operating equipment, standing in unsafe places, or in a way that could injure you or others. If you have persistent sleep problems, health concerns, or difficulty waking that may relate to a medical condition, consult a qualified health professional.

Mission submissions and permissions

If you submit photos, recordings, text, or other content as part of a mission, you represent that you have the right to provide that content and that it does not violate law or the rights of others.

You grant MornUp permission to process mission submissions and related metadata as needed to operate, verify, secure, troubleshoot, and improve the app. You can manage device permissions in iOS settings, but disabling a required permission may make related missions unavailable.

Acceptable use

You may not misuse MornUp, interfere with the service, attempt unauthorized access, reverse engineer protected parts of the app except where law allows, upload unlawful or harmful content, bypass mission verification, or use the app to violate the rights of others.

You may not use MornUp in a way that harms the service, other users, Apple, service providers, or third parties.

Support, maintenance, and availability

Support is available at support@mornup.app and through the support information on the website. We may modify, suspend, or discontinue parts of MornUp at any time for maintenance, security, product changes, legal reasons, or service availability.

We do not guarantee that every support request will result in a particular fix, response time, refund, or feature change.

Third-party services

MornUp may rely on Apple, RevenueCat, Supabase, automated image verification providers, and other service providers. Their services may be subject to their own terms, privacy policies, limits, and availability.

Intellectual property

MornUp, including its design, software, branding, text, graphics, and features, is owned by us or our licensors and is protected by intellectual property laws.

These Terms do not give you ownership of MornUp. They give you a limited, personal, non-transferable right to use the app according to these Terms and any applicable App Store license terms.

Termination

You may stop using MornUp at any time. We may suspend or terminate access if we believe you violated these Terms, created risk for the service or other users, or if we are required to do so by law.

Disclaimers and limitation of liability

To the maximum extent permitted by law, MornUp is provided as is and as available. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, missed alarms, lost opportunities, or purchase issues handled by Apple.

Nothing in these Terms limits liability that cannot legally be limited.

Changes to these Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you. Continued use of MornUp after changes become effective means you accept the updated Terms.
